GENERAL PROVISIONS
1.1. This document constitutes an Agreement between the online store enkospace.com, hereinafter referred to as the "Seller," and any user of the store's services, regardless of status (individual, legal entity, or individual entrepreneur), hereinafter referred to as the "Buyer."1.2. This Agreement defines the terms of purchasing digital products, hereinafter referred to as "Products," by the Buyer through the Seller's online store.1.3. The Agreement is public in accordance with Articles 633 and 641 of the Civil Code of Ukraine and is equivalent to a "verbal agreement," having full legal force.1.4. In accordance with Article 642 of the Civil Code of Ukraine, full and unconditional acceptance of the terms of this offer, confirmed by the Buyer's payment for the ordered products on the website, constitutes the conclusion of the Agreement on the proposed terms.1.5. For the purposes of this Agreement, unless the context requires otherwise, the following terms shall have the meanings specified below:
"Online Store" — the Seller’s website, created for concluding retail and wholesale purchase agreements after the Buyer reviews the Seller’s offered Products."Seller" — the entity, regardless of its organizational and legal form, and/or an individual entrepreneur engaged in the sale of Products."Products" — digital items offered for sale and listed on the Seller’s website."Buyer" — an individual or legal entity placing an order on the Seller’s website."Recipient" — an individual or legal entity designated by the Buyer to receive the ordered Products."Acceptance" — full and unconditional agreement by the Buyer to the terms of this Agreement."Order" — specific items selected from the Product range by the Buyer when placing an order on the website.
SUBJECT OF THE AGREEMENT
2.1. The Seller provides access to and delivery of digital Products in accordance with the current pricing published on enkospace.com, and the Buyer pays for and receives the Products as per the terms of this Agreement.
ORDER PLACEMENT
3.1. Order Process3.1.1. Orders are accepted via the website 24/7. Processing occurs during the Seller's working hours.3.1.2. All Products are digital and delivered electronically, without physical shipment.3.1.3. Buyers must provide accurate email addresses for delivery. Incorrect information may delay order processing.
3.2. Payment Process3.2.1. Payment for the Order confirms the Buyer's acceptance of this Agreement.3.2.2. Payment is made in advance via payment methods listed on the website. The Order is considered paid on the date the funds are credited to the Seller’s account.3.2.3. Prices for Products listed on enkospace.com are valid at the time of order placement.3.2.4. Orders are processed only after payment is received.
3.3. Delivery of Digital Products3.3.1. Products are delivered electronically to the email address specified during checkout or made available for download in the Buyer’s account.3.3.2. The delivery is considered completed once the Buyer receives access to the digital Products.
RETURNS AND REFUNDS
4.1. Due to the nature of digital Products, refunds are only provided if the Product is not delivered.4.2. Buyers may request a refund by submitting a claim via the contact form on the website, providing relevant details and proof.4.3. Refund claims are reviewed within 3 business days, and the Buyer will be informed of the decision electronically.
INTELLECTUAL PROPERTY
5.1. The Seller retains exclusive intellectual property rights to all digital Products offered on enkospace.com.5.2. Unauthorized distribution, modification, or resale of digital Products is strictly prohibited and may result in legal action.
DURATION OF THE AGREEMENT AND MODIFICATIONS
6.1. Acceptance of this Agreement constitutes its conclusion.6.2. The Agreement is effective from the moment of payment until the full delivery of the Products.6.3. The Seller reserves the right to modify this Agreement without prior notice. The current version is always available on the website.
PRIVACY
7.1. The Seller ensures the confidentiality of the Buyer’s personal information provided during order placement.7.2. Personal data is processed solely for order fulfillment and is not shared with third parties unless required for transaction processing.
LIABILITY
8.1. The Seller is not responsible for issues arising from incorrect or incomplete information provided by the Buyer.8.2. Any disputes unresolved through negotiations shall be settled in accordance with the legislation of Ukraine.
